Social media: One click to prison?

Social media platforms have become an indispensable part of information and communication sharing today. But these platforms, beyond being a space of free expression, are also areas subject to law. So, when can social media posts lead to legal sanctions? In this article, let’s examine some important points we should pay attention to when using social media.
Insult and Slander: If the posts made on social media are insulting or slanderous, they can be punished according to the Turkish Penal Code. Insult is directing degrading words to a person, while slander is not being able to prove a concrete fact attributed to a person. Such posts may be subject to investigation upon complaint by the victim and may lead to imprisonment or fines.
Violation of Privacy: Sharing private photos or videos of others on social media without permission may be considered a violation of privacy. Such posts may be subject to a compensation lawsuit because they harm the personal rights of the victim.
Copyright Violation: Sharing or reproducing copyrighted works of others on social media without permission may be considered copyright infringement. Such shares may be subject to a lawsuit for compensation by the rights holder.
Threat and Blackmail: If the posts made on social media can be considered as a threat or blackmail to a person, they can be punished according to the Turkish Penal Code. A threat is a promise to harm someone through an unlawful act in order to instill fear. Blackmail, on the other hand, is trying to gain an unfair advantage by threatening to disclose matters that will harm a person’s honor or reputation.
To Avoid Legal Liability:
- Be careful to use careful and respectful language in your social media posts.
- Avoid sharing other people’s private information or images without permission.
- Do not share or reproduce copyrighted works without permission.
- Make sure that your posts do not threaten or blackmail anyone.
- When you encounter illegal content, report it to the relevant platforms or competent authorities.
Although social media platforms offer a free space, it is important to be aware of legal limitations. By being careful and responsible in your posts, it is possible to protect yourself from legal sanctions and not violate the rights of others.
Remember, getting into prison with the click of a button is not as remote as it seems.
